Welcome to Green Shoes website.
The following rules and
regulations apply to all visitors or users of the Green Shoes website. By using
this website, you agree to be bound by these rules and regulations. We reserve
the right to update or modify these Terms and Conditions at any time, without
prior notice. For this reason, we encourage you to review these Terms and
Conditions whenever you use this website. If you do not agree to these terms,
please do not use the Green Shoes website.

Product Orders
Any order placed by you through
the Green Shoes website is an offer by you to purchase a particular product(s)
for the price (including the delivery and other charges and taxes) where
applicable specified on this website at the time you place your order. We
reserve the right to accept or reject your offer for any reason, including,
without limitation, the unavailability of any product, an error in the price or
the product description posted on this website, or an error in your order. The
rejection of any offer is at the sole discretion of Green Shoes. Your contract
only comes into existence when you are forwarded a confirmation of receipt of
your order and payment. If we do not have the goods you order in stock, you
will be offered an alternative before we despatch your order. If this occurs
you may accept the alternatives we offer, cancel your order or leave the order
valid, but tell us to omit the out-of-stock item/s. If your credit card has
already been charged for an order that is subsequently cancelled, Green Shoes
shall issue a credit to your credit card account.
Product Information
We will always attempt to be as
accurate as possible with our product descriptions and pricing. However, we are
unable to warrant that product descriptions or other content on the website is
accurate, complete, reliable, current or error free.
Delivery and charges
Orders that are priced at $99 and
under will incur a $5.00 delivery fee in New Zealand to urban addresses.
Rural Delivery orders that are priced under $99 will incur a $9 fee.
Orders that are priced at $100 and over will not incur shipping.
We will use all reasonable endeavours to ensure that orders for tangible goods
will be dispatched promptly after an order has been placed.
Pricing
All prices are in New Zealand
Dollars and are inclusive of any Goods and Services Tax ("GST")
unless stated to be otherwise. All prices are correct when published. We
reserve the right to alter prices at any time.
An order confirmation will be
emailed to you at the email address you supply when you place your order. You
are responsible for ensuring that your contact details are correct.

All payments are processed via
DPS's secure payments system to ensure high levels of payment security and are
subject to DPS's terms and conditions.
Shipping and delivery
We endeavour to ship on the day
the order is received as long as the order is completed by 2pm. If the order is
placed on a weekend we’ll ship on the next business day.
All items will be tracked.
Returns
While the Consumer Guarantee Act
and Fair Trading Act provide the basis for the Green Shoes website, we want our
customer service offering to deliver beyond this. Green Shoes has a 30 days
money back guarantee on all stock (does not include courier fee) with printed proof of purchase. For a
product to be returned under our policy, that product must be in the original
resaleable condition, in original packaging unless faulty or otherwise
deficient. It is this policy that provides you no risk and 100% satisfaction

NOTE: These products are still guaranteed under the Consumers Guarantees Act.
Consumer Guarantees Act 1993
The Consumer Guarantee Act sets out minimum standards for goods sold. In the
event that goods sold are not of good quality or are faulty, the customer has
the right to a repair, replacement or a refund.
Fair Trading Act 1986
The Fair Trading Act is designed to protect the customer being misled, either
intentionally or unintentionally. This applies to all aspects of the promotion
and sale of goods and services including: pricing; where the product was made;
where the product is from; the meeting of New Zealand safety standards;
availability of products in store and the sales techniques used. The Commerce
Commission enforces the Fair Trading Act 1986.
1. Money Back Guarantee - on all stock (Please note this does not include courier fee)
If the product purchased is returned within 30 days of purchase in the
"Original Condition and Packaging” with "Proof of Purchase” a refund
will be available. The refund will be processed by Green Shoes in the same
tender as the original purchase, for example, the Credit Card used at purchase
will be the Credit Card used to process the refund. Please note: Refunds will
only be provided on goods returned in their original condition and packaging
unless faulty or otherwise deficient.
2. Exchange
If a product is unsatisfactory, Green Shoes can offer to exchange it for
another one (i.e. a different size, colour etc) or another product of the same
value. You are not required to pay for standard delivery on the outgoing
replacement parcel. Proof of purchase is required in order to get an exchange.
Please note, as mentioned above, products returned or exchanged must be in a
resaleable condition with original packaging intact and all labels etc returned
with the item.
3. Repairs/Faulty Goods
If the returned product has a manufacturing fault that can be repaired, then
Green Shoes will arrange for the repair at Green Shoes expense. If the product
has no warranty, or the fault is caused through fair wear and tear, then Green
Shoes can get the product repaired at the customer’s request, however the cost
of the repair will be charged to the customer.
If the product returned has a manufacturing fault that cannot be repaired or
replaced, Green Shoes will offer a full refund or Credit Note including any
postage charges depending on your preference. If you have any enquiries please

Wherever possible we will endeavour to repair any manufacturing fault to a
factory issue standard and return it to you FREE of charge.
Where a repair is not possible or practical on a product with a manufacturing
fault, we will replace the product with the same or similar product if available.
If a replacement is not available we will give you the option to either
exchange it for any of Green Shoes products of the same value as your original
purchase price OR provide a full refund OR Credit Note including any postage
charges depending on your preference.
Liability Limitation
Where you acquire or hold
yourself out as acquiring goods or services from us for the purposes of a
business, the provisions of the Consumer Guarantees Act 1993 will not apply.
The conditions, warranties and guarantees set out in the Sale of Goods Act 1908
or otherwise implied by statute or common law will not apply and are excluded
from these terms of trade.
We will always endeavour to have complete and accurate information on our
website but to the greatest extent permissible by law we assume no responsibility
for the completeness and current accuracy of the information provided on our
website.
To the greatest extent permissible by law, we exclude all liability we may have
to you for any claim except where we have acted in bad faith. This exclusion
also applies for the benefit of every officer, employee, contractor, agent of
us and anyone else we use to perform our duties or provide services under any
agreement you have with us. None of the persons specified above is liable or
has to pay you for anything else in connection with or resulting from anything
any of us does or does not do, or delays in doing, whether or not it is
contemplated or authorised by any agreement you have with us. This exclusion
applies whatever you are claiming for and in whatever way liability might
arise. This exclusion does not limit any inalienable rights you may have under
the Consumer Guarantees Act 1993.
Our maximum liability to you (if any) shall be limited to the value of any
faulty products or services supplied by us and we, our employees, contractors
and agents, will not be liable to you for loss or damage of any kind however
that loss or damage is caused or arises.
Applicable law and jurisdiction
Unless we otherwise agree in writing, this agreement contains all the terms of
our relationship and continues to apply no matter where you are located at the
time any goods or services are provided to you by us and irrespective of the
location where you reside.
Use of our website, supply of products or services by us to you and any
other matter arising from these Terms and Conditions are subject to the laws of
New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction
over all claims or disputes arising in relation to, out of or in connection
with these terms of trade, or with the use of website or supply of any
services.
Where you or any other person who you act for, or who you permit to act for you
supplies incorrect information for the purchase of a product or service and we
incur cost in any matter concerning that name then we may recover the costs
incurred by us from you (including legal costs on a solicitor-client basis).
You agree to use our website, products and services in accordance with the
applicable laws of the country or countries where your business or organisation
is based.
Privacy policy and Confidentiality
Unless you opt to receive
messages from us we will not contact you again in future. If you have opted to
receive ongoing communications and at a later date you no longer wish to
receive these communications you will be able to opt out of receiving this
information by contacting us by email or by following the unsubscribe
instructions at the bottom of emails sent to you.
Opting out of receiving the above mentioned messages will not prevent the
sending of messages that specifically relate to your order(s).
We may use personal information that we collect about you to provide products
and services to you and to administer orders and payments relating to your
purchases from us.
You will need to permit us to place data files ("cookies") on your
computer to enable you to use some features of some of our websites. Where you
choose not to enable cookies from our websites, some functionality of those
websites may not be available to you.
We may disclose your personal information as required by law.
Where you have provided information to us on a confidential basis, we will hold
that information in confidence, except as required by law. We cannot guarantee
that our website is secure, and we cannot be held responsible for a breach of
our website security that is beyond our control.

to correct it, at any time.
